Terms And Conditions

1.2. You may be required to accept and agree to be bound by additional terms and conditions (“Additional Terms”) for availing the specific Service You choose. The applicable Additional Terms are set out at the point of access to the relevant Services. These Additional Terms are in addition to, and not in derogation of these Terms. In the event of any of these Terms conflicting with any Additional Terms, the Additional Terms shall prevail to the extent of such conflict, in respect of, and to the extent it relates to that Service.

1.3. The Services are provided by Us on a commercially reasonable effort, and You agree that availing the above-mentioned Services is purely at Your will and consent.

1.4. CreditMantri may, at its discretion, add, modify, or remove any of the Services or any Platform features from time to time without any notice.

1.5. CreditMantri may in some instances partner with third parties for facilitating the provision of certain Services to You, which may, inter alia, include services in connection with collection of KYC information, conducting credit assessment checks and facilitating payments.

1.6. You agree and acknowledge that CreditMantri only provides the Services and facilitates the provision of certain third-party products (“Products”) on the Platform. The Products availed by You through the Platform are provided to You by third parties who have partnered with Us (“Partners”), and the details of such Partners are available on the Platform. You acknowledge that CreditMantri provides You the Services pertaining to the Products in the capacity of an intermediary and under no circumstances should You expect CreditMantri to provide the Products directly to You or be responsible for any deficiency or failure in providing You the Products. Further, You understand that all responsibility with regard to compliance with applicable laws in relation to the Products shall be on the Partners and in no circumstance will CreditMantri be required to acquire licenses or comply with such other requirements with regard to the Products under applicable laws. The Products provided by the Partners may be subject to separate terms and conditions or such other agreement between You and the Partner(s) as may be intimated to You by the Partner, and You agree and acknowledge that CreditMantri is neither a party to such terms nor will it be liable thereunder for any reason whatsoever.

1.7. CreditMantri does not: (i) adopt any 'unfair trade practices' either on the Platform or otherwise at the time of facilitating the Products; (ii) make any misleading or false advertisements of any products or services or advertisements prohibited by applicable law; and (iii) discriminate between Users of the same class or make any arbitrary classification of the Users.

2.1. You acknowledge that the We allow You to avail the Services and give you a personal, limited, non-exclusive, non-transferable and non-assignable license to access the Platform.

2.2. All content, data, design, information or other materials available on and underlying the Platform (collectively “Content”), including but not limited to software underlying the Platform or which are required for accessing or using the Platform, images, text, layouts, arrangements, displays, illustrations, photographs, graphics, audio and video clips, HTML files and other content, logos, trademarks including the trademark ‘CreditMantri’ and other trademarks that may be used on the Platform are the property of CreditMantri and/or Our licensors and are protected by copyright and/or other applicable intellectual property rightlaws. You may use the said Content only for Your own personal, non-commercial use in connection with Your use of the Services, subject always to these Terms. You are not permitted to copy, reproduce, publish, perform, communicate to the public in any manner whatsoever, transmit, sell, license, distribute or transfer in any manner whatsoever, adapt, modify, translate, disassemble, decompile or reverse engineer, create derivative works from, or in any way use or exploit the Platform, the Service(s), the Content or any part thereof except for your personal, non-commercial use in accordance with these Terms.

2.3. You shall not remove or obliterate any copyright, trademark or proprietary rights notices from the Content or the Platform and shall reproduce all such notices on all authorized copies of the Content. Use of the Platform, the Service(s) and/or Content in violation of these Terms may violate copyright, trademark, and other applicable laws, and could result in appropriate legal action.

2.4 All rights, title and interest in the Platform, the Service(s), and the Content, except the limited license granted to You as per these Terms, are exclusively reserved by CreditMantri.

3.1 Subject to the conditions under Section 4 below, the use and access to the Platform is available only to persons who can be legally bound by contract and who are not disqualified or declared incompetent under the Indian Contract Act, 1872. You hereby represent that You are: (i) of legal age to form a binding contract, i.e., above 18 (eighteen) years of age; (ii) not a person barred from receiving the Services from Us under the applicable laws; and (iii) competent to enter into a binding contract. In case You are accessing the Platform as a representative of and on behalf of a legal entity or organisation, (i) You represent and warrant that You have the full authority to represent the legal entity and have power to bind them; and (ii) You understand that the Privacy Policy is applicable to and binds all other persons accessing or using the Platform and the Services on behalf of the same legal entity or organisation for this purpose. Further, You agree and acknowledge that provision of certain Services to You shall be subject to You passing the credit assessment checks that CreditMantri may undertake in the process of creating Your Account (defined below) on the Platform.

4.1. You may browse certain sections of the Platform without being registered with Us. However,to avail some of the Services, You are required to set up an account on the Platform (“Account”) by registering and creating an Account using Your mobile number. To register and activate Your Account, You will be required to provide certain personal information to CreditMantri as provided under the Privacy Policy. Once You are registered with Us, You could choose to login using Your social media log-in or such other alternative modes of trusted authentication.

4.2. You may also be required to submit certain information/documents to Us, stipulated as per Our policies as applicable from time to time. The details of the information/documents that We collect and how We use this information/document(s) are detailed in the Privacy Policy available on Our website. If these Terms and Conditions read with the Privacy Policy are not acceptable to You, please do not provide any of Your information to CreditMantri. However, in such event, We may not be able to provide You with our Service or some parts of it.

4.3. The information and/or documents requested are not an exhaustive list of requirements and CreditMantri reserves the right to require additional documents and/or information as may be deemed necessary by CreditMantri in its sole discretion, to complete its internal verification process. In the event the details or documents submitted are incomplete or discrepant, CreditMantri will request additional information/documentation through email or SMS or WhatsApp sent to the email ID/mobile number as provided by You. In case the discrepancies remain unresolved or if CreditMantri is unable to successfully complete its internal verification in accordance with its policies, CreditMantri shall have the right to reject your request for registering with the Platform and/or providing Services or any part thereof. CreditMantri reserves the absolute discretion to accept or reject Your request for creating an Account and/or availing any of the Services, without assigning any reasons for the same. CreditMantri shall have the right to prevent You from accessing certain features or Services, based on various criteria, as may be determined by CreditMantri at its sole discretion.

4.4. You are prohibited from selling, trading, or otherwise transferring Your Account to another party. Further, You shall ensure and confirm that the Account information and all information provided by You is complete, accurate and up-to-date. If there is any change in the Account information, or if any information is found to be incomplete or incorrect, You shall promptly update Your Account information on the Platform or request Us for an information revision or update. If You provide any information that is untrue, inaccurate, unauthorised, not current, or incomplete (or becomes untrue, inaccurate, not current, or incomplete), or if We have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, We have the right to refuse or reject providing the Services to You on the Platform.

4.5. You hereby acknowledge and agree that the deletion of Our mobile app from Your device does not constitute termination of Your Account and in order to terminate Your Account, you may request Us to delete Your Account by writing to Us at datagrievance@creditmantri.com. After deletion of Your Account, Your personal information will be retained or erased in accordance with the Privacy Policy.

4.6. You are responsible for maintaining the confidentiality of the Account information, safeguarding the password or credentials that You use to access the Platform and for any activities or actions under Your Account. In case a password is required to sign-in to Your Account, You are encouraged to use "strong" passwords (passwords that use a combination of upper and lower-case letters, numbers and symbols) with Your Account and with other accounts that You may connect to Your Account (such as Your Accounts with other social media platforms).

4.7. You agree to immediately notify the Company of any unauthorized use of Your Account information or any other breach of security. The Company will not be liable for any unauthorised use of Your Account, or any loss that You may incur as a consequence of unauthorized use of Your Account either with or without Your knowledge.

5.1. You may use the Platform and the Service(s) solely for Your own personal and non-commercial use, subject to these Terms and any Additional Terms that You may accept and agree to be bound by.

5.2. You shall not use the Platform, the Service(s), the Content, or any part thereof for any purpose that is unlawful or not permitted by these Terms. Without prejudice to the generality of the above, You shall not use the Platform, the Service(s), the Content, or any part thereof to host, display, upload, modify, publish, transmit, update, or share any information that:

6.1. Our credit health assessment service is offered to You free of cost as soon as you sign up and pull your Credit Information Report (“CIR”) on our website or mobile app. We will require access to Your personal information including Your CIR for providing You this Service and we will collect it in accordance with the Privacy Policy. You agree to seek Your CIR from credit information companies authorised under applicable laws (“CICs”) using the Platform and disclose the CIR to Us. CreditMantri may use the said CIR to determine Your eligibility for access to various Products. CreditMantri may at its sole discretion prevent You from accessing certain Platform features and the Services in part or in whole if Your credit score is lower than a minimum entry threshold required for a particular Service, which threshold shall be decided by CreditMantri in its sole discretion. By signing up for and availing the credit health assessment service, You may be required to agree to such Additional Terms which CreditMantri may require from time to time.

6.2. You acknowledge that CreditMantri is not a CIC, and the CIR has been obtained from an authorised CIC on Your behalf. The CIR is fetched by CreditMantri on Your behalf and subsequently presented to You based on Your authorisation. The CIR is presented to You on an ‘as is’ basis, however, CreditMantri may make changes to the format of the CIR to make it more reader friendly without changing the contents therein.

6.3. Any information that CreditMantri displays on its Platform regarding Your creditworthiness, credit score or credit health is as per Your CIR fetched from a CIC. CreditMantri does not make any representations or warranties as to the accuracy or completeness of such information. CreditMantri will not be liable for any consequences You may face as a result of Your reliance on such information.

6.4. If You have noticed any discrepancy in Your CIR or otherwise have any queries regarding the same, please reach out to the relevant CIC whose details are available in the Additional Terms agreed by You.

6.5. When You allow CreditMantri to access your CIR:

7.1. As a lending service provider (LSP), We facilitate the provisioning of financial products/services from Our Partners (banks or other financial institutions). In Our capacity as an LSP, We do not provide any Products (such as loan facilities or credit cards) to the Users. Such Products are provided by lenders such as banks and/or NBFCs (who are Our Partners) and based on Your choice of Product. CreditMantri merely facilitates the provision of such Products to You.

7.2. In the event You wish to avail any of the Products offered by Our Partners using our Platform, We will require access to Your personal information including Your credit information for providing You this Service. We will use the information derived from Your CIR to qualify You or to assess Your eligibility for various Products on the Platform. Please refer to Our Privacy Policy for more information.

7.3. We act as a service provider for Our Partners and act on the instructions and in accordance with Our contract with Our Partners. The Products availed by You, if any, are pursuant to a contract between You and the relevant Partner. CreditMantri merely facilitates the provision of the Products to You. CreditMantri shall not be liable for approval or rejection of Your application for the Products or any other aspect of the same.

7.4. Any information that CreditMantri displays on its Platform regarding the Products or Our Partners is as per the information provided to CreditMantri by such Partner. CreditMantri provides such information to You on an as is basis and to the maximum extent permitted under law, CreditMantri does not make any representations or warranties as to the accuracy or completeness of such information. CreditMantri will not be liable for any consequences You may face as a result of Your reliance on such information. You are advised to carefully read and understand the terms of the Products that You intend to avail.

7.5. The relevant Partner with whom You have entered into an agreement for a Product is solely responsible for executing such agreement, as applicable to You.

7.6. While CreditMantri shall endeavour to provide a real time status of the Products facilitated through the Platform, as provided by the Partner to CreditMantri, on an ‘as-is’ basis, CreditMantri is not responsible for any error or omission which may arise due to reasons beyond the reasonable control of CreditMantri.

8.1. The Platform may contain materials contributed by third parties and links to third party websites or resources on the Platform. CreditMantri does not approve or endorse any of the materials contributed by third party websites or any such third party websites. The provision of any such materials or links to external websites shall not constitute any form of co-operation or affiliation with CreditMantri and any such third parties or external websites.

8.2. The provision of, or assistance in providing, materials contributed by third parties on this Platform or links to external websites give rise to no statement, representation or warranty, express or implied, that CreditMantri agrees or does not disagree with the contents of any such materials or external websites and CreditMantri will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) however arising from or in respect of any use or misuse of or reliance on the contents of any such materials or external websites delivered on or via this website or inability to use any of them.

8.3. You agree that You access any such third-party sites at Your own risk and shall solely bear all consequences associated with Your access to, and use of, such third-party websites. Such thirdparty sites may have separate terms and conditions and privacy policies, and which are independent of CreditMantri and therefore, please read such third-party terms before You access any such third-party site. These Terms shall not govern Your access to such third-party website or links.

9.1. The Platform and the Content on the Platform is owned by CreditMantri or Our licensors and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights.

9.2. The trademarks, logos and service marks displayed on the Platform (“Marks”) are the property of CreditMantri or other respective third parties, as the case may be. You are not permitted to reproduce or distribute or otherwise use the Marks without the prior consent of CreditMantri or the third party that may own the Marks.

9.3. You acknowledge and agree that any feedback, comments, or suggestions You may provide regarding the Platform or the Services are entirely voluntary, and the Company will be free to use such feedback, comments, or suggestions as it sees fit and without any obligation to You.

10.1. Your privacy is important to Us. Our Privacy Policy explains how We collect, use, handle and share personal information and other data. Please refer to Our Privacy Policy available at https://www.creditmantri.com/privacy-promise/.

11.1. You agree to indemnify, defend, and hold harmless CreditMantri, its subsidiaries, affiliates, and their officers, employees, directors, shareholders, agents, partners, vendors, and licensors (each, a “Indemnified Party/ies,”) from and against any and all claims, costs, proceedings, demands, losses, damages, and expenses (including reasonable attorneys’ fees and costs) of any kind or nature arising from, out of, in connection with, or relating to: (i) any breach or nonperformance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to these Terms, or Privacy Policy; or (ii) use of the Platform. CreditMantri may select counsel for and control the defence of any claim that You are indemnifying. Further, You agree to hold the Indemnified Parties harmless against any claims made by any third party due to, or arising out of, or in connection with, Your use of the Platform, any misrepresentation with respect to the data or information provided by You, Your violation of the Terms, or Your violation of any rights of another, including any intellectual property rights.

12.1. You expressly acknowledge, understand and agree that:

You agree that any violation by You of these Terms will constitute an unlawful and unfair business practice, and will cause irreparable harm to CreditMantri, for which monetary damages would be inadequate, and You consent to CreditMantri obtaining any injunctive or equitable relief that they deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies that CreditMantri may have at law or in equity. If CreditMantri takes any legal action against You because of Your violation of these Terms, they will be entitled to recover from You, and You agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief that may be granted.

14.1. The Terms will continue to apply until terminated by either You or CreditMantri as set forth below. If You object to the Terms or are dissatisfied with the Platform, You may (i) close Your Account on the Platform; and (ii) stop accessing the Platform. You may terminate these Terms and request deactivation of your Account and withdrawal of related consents by writing to security@creditmantri.com. Your Account will be deactivated within 3 working days from receipt of such email

14.2. CreditMantri may delist You or block Your future access to the Platform or suspend or terminate Your Account if it believes, in its sole and absolute discretion that You have violated any term of these Terms or the Privacy Policy or in any way otherwise acted unethically or any other reason that CreditMantri may deem fit. Notwithstanding anything in this Section, all terms which by their nature are intended to survive such termination, will survive indefinitely unless and until CreditMantri chooses to terminate them.

15.1. Grievance Handling: If You have any grievances, or complaints or concerns with respect to the Platform, the Content, or the Services, You can contact the designated Nodal Grievance Officer of CreditMantri, namely, Ms. Sandhya Srinivasan (Service Head & Nodal Officer), at grievance@creditmantri.com.

15.2. The Nodal Grievance Officer of CreditMantri shall acknowledge the User grievances or complaints or concerns with respect to the Platform, the Content, or the Services, within 24 (twenty-four) hours of receipt of the same and shall endeavour to redresses the same at the earliest and in no event later than timelines prescribed by the relevant applicable laws. By lodging a complaint or grievance, You agree to provide complete support to the Nodal Grievance Officer and such reasonable information as may be sought by them from You.

15.3. CreditMantri shall not be responsible to redress grievances of users with regard to any of the services or Products provided by its Partners whether the service or Product is availed through the Platform or not. You should read the grievance redressal policy as well as other terms and policies of such Partner, prior to availing their Products or services.

16.1. CreditMantri may revise or modify or amend these Terms at any time. In the event of any such revisions, We will notify You of the revised Terms by sending You an email or when You access the Platform and update the “Last Updated” date at the top of these Terms.

17.1. You hereby expressly agree to receive communications by way of SMS, WhatsApp and/or emails from CreditMantri relating to the Services provided through the Platform. You can unsubscribe/ opt-out from receiving communications from CreditMantri anytime by visiting the Platform. In which case, the Company will only send You communications solely required for the purposes of the Services provided through the Platform.

18.1. Notice: All notices from CreditMantri will be served by email to Your registered email address or by general notification on the Platform.

18.2. Assignment: You cannot assign or otherwise transfer the Services availed by You, or any rights granted hereunder to any third party. CreditMantri’s rights under the Terms are freely transferable by CreditMantri to any third party without the requirement of seeking Your consent.

18.3. Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Terms, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.

18.4. Force Majeure: CreditMantri shall not be liable to You for its failure to perform or for delay in providing You access to Your Account or to the Platform or any Services thereof, to the extent such failure or delay results from causes beyond its reasonable control, including, without limitation, acts of God, fires, explosions, wars or other hostilities, insurrections, revolutions, strikes, labour unrest, earthquakes, floods, pandemic, epidemics or regulatory or quarantine restrictions, unforeseeable governmental restrictions or controls or a failure by a third party hosting provider or internet service provider or on account of any change or defect in the software and/or hardware of Your computer system.

18.5. Choice of Law and Jurisdiction: These Terms will be governed by and construed in accordance with the laws of India, without giving effect to any conflict of laws rules or provisions. Any disputes arising in relation hereto between You and any Company shall be subject to the exclusive jurisdiction of courts at Chennai, India.

18.6. Waiver and Severability: The failure by CreditMantri to enforce any right or provision of these Terms will not prevent CreditMantri from enforcing such right or provision in the future and will not be deemed to modify these Terms.
